RESOLUTION 16-048
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON, DECLARING AN EMERGENCY AND RATIFYING THE CITY
MANAGER'S APPROVAL OF ALL APPLICABLE DOCUMENTS TO ALLOW FOR THE
REPAIR OF THE BOILERS AT MOUNTAIN VIEW COMMONS
WHEREAS, Section 3.46.090 of the City of Port Townsend Municipal Code, and Section
39.04.280(1)(c) of the Revised Code of Washington allows exemptions to competitive bidding
requirements under emergency conditions; and
WHEREAS, on the evening of October 17, 2016 the pressure relief valve on the domestic hot
water heater at Mountain View Commons failed causing water to flood the boiler room which in turn
resulted in damage to the controls panels on both boilers; and
WHEREAS, this damaged has rendered the boilers inoperable thus cutting off building heat and
hot water to the main building, pool and gym; and
WHEREAS, the City Manager has declared repairs to the boiler system an emergent situation
based on the need to provide heat and hot water to tenants at Mountain View; and
WHEREAS, the City's municipal code requires City Council to concur with the City Manager's
declaration of emergency by passage of a resolution; and
WHEREAS, the City Council finds that it is in the best interest of the City to declare an
emergency and authorize the execution of all necessary documents to repair the Mountain View
Commons boilers;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port Townsend
as follows:
Section 1. The City Council hereby declares an emergency justifying the waiver of certain
contracting processes.
Section 2. Staff's actions as set out in Public Works Director Ken Clow's Memorandum dated
October 25, 2016 (Exhibit A), are ratified and confirmed.
Section 3. The City Manager may take any additional administrative actions consistent with this
Resolution.

MEMORANDUM
TO: David Timmons, City Manager

SUBJECT: Mountain View Commons Boiler Damage—Emergency Condition
DATE: 25 October 2016
On the evening of Monday, 17 October 2016 a pressure relief valve on the domestic water heater
for the Mountain View Commons failed resulting in water overflowing the tank and flooding the
surrounding area. The floor drains and sump pump were not able to keep up with the over flow.
The lowest part of the boiler room which houses the two boilers for the facility was flooded,
damaging the boilers' electronic control panels, related electrical and mechanical components,
and the boiler's insulation. City facility staff discovered the condition on Tuesday morning, 18
October. The power to the boilers was shut off. The space was pumped out and fans brought in to
dry out the damaged boiler systems.
The failed water heater provided hot water for building heat and domestic hot water for the entire
facility including the pool. Electric space heaters were provided for limited heating in work
areas, but the remaining areas are without heat or hot water. The pool is currently closed until the
heat can be restored.
Repair parts for the water heater were ordered and a local plumber is making the necessary
repairs. The boilers and the damaged control systems pose a more challenging problem as
replacement parts must come from the boiler manufacturer and the repairs need to be made by
qualified technicians. The parts have been ordered but the anticipated delivery is approximately
two weeks from now. Technicians have been identified to complete the repairs once the parts
arrive.
With the cost of the boiler parts alone exceeding $25,000, the total cost to restore the two boilers
and water heater could cost approximately $40,000.
Due the lack of heat and domestic hot water in this much used facility and the impending colder
weather, we are asking that this situation be declared an emergency to expedite the repair work
to the fullest extent possible.
