THIS WATER EASEMENT (the "Agreement") is made this l U'day of October, 2016 (the
"Effective Date"), by and between Jefferson County Public Hospital District No. 2, a Washington
Municipal Corporation(the "District")and the City of Port Townsend, WA(the"City").
RECITALS
A. The District is the owner of certain real property located in Jefferson County,
Washington, as legally described on Exhibit A attached hereto and incorporated herein by
this reference(the"District Property"herein).
B. The Parties desire to enter into this Water Easement Agreement for the benefit of the City
to allow for water main construction and for the purpose of obtaining water for the
District's project on the property.
AGREEMENT
NOW, THEREFORE, for and in consideration of good and valuable consideration, the
receipt of which is hereby acknowledged,the parties hereto agree as follows:
1.
Non-Exclusive E sement for-WaterMain Cod trawtion. The District does hereby declare,
grant, establish and convey to and for the benefit of the City, a non-exclusive perpetual
easement over, across, under and along the that portion of the District's Property legally
described in Exhibit A attached hereto and by this reference incorporated herein (the
"Water Easement Legal Description) for the purpose of installing, laying, operating,
maintaining, inspecting, removing, repairing, replacing, relaying, and adding to, from time
to time, pipe or pipes, with necessary fittings,, appurtenances, and attached facilities,
including laterals and connections for the transmission and distribution of water and/or the
collection of wastewater. The Water Easement Area is depicted on the map attached hereto
as Exhibit B and by this reference incorporated herein(the"Sketch of Easement Area").
