Project Name: Modify Marina
Project Description: Modify the Point Hudson Marina to include the replacement of the existing
overwater structures. Maintenance dredging authorized under previous
version(s)of this HPA has been completed and is not authorized under this
version (07). Impact driving to include proofing of piling is not authorized
under this version (07).
PROVISIONS
1. TIMING LIMITATIONS: The project may begin February 15, 2006 and shall be completed by
June 14, 2007, provided:
a. Work waterward the ordinary high water line using equipment and vessel(s) shall not occur
from February 15 through July 14 of any year for the protection of migrating juvenile salmonids
except:
b. Vibratory pile driving is authorized between February 15 through March 14 provided a
qualified biologist is on-site observing for the presence of juvenile salmonids during all pile driving
activities; and
b. Work on overwater structures using hand tools only may occur year around.
2. PLANS: Work shall be accomplished per plans and specifications entitled, Point Hudson Marina
Renovation Sheets 1-12, dated April 19, 2006 and the modified Point Hudson Marina Renovation
Sheets 1-3, dated January 17, 2007 and submitted to Washington Department of Fish and Wildlife,
except as modified by this HPA. A copy of these plans shall be available on site.
3. NOTIFICATION REQUIREMENT: The Area Habitat Biologist (AHB) listed below shall receive
written notification (FAX: 360-876-1894 or e-mail: thursrlt@dfw.wa.gov)from the person to whom
this Hydraulic Project Approval (HPA) is issued (permittee) or the agent/contractor no less than
three working days prior to the start of construction activities. The notification shall include the
permittee's name, project location, starting date for work, and the control number for this HPA.
4. NOTIFICATION REQUIREMENT: The Enforcement Sergeant listed below shall receive written
notification (FAX: 360-664-0689 or mail: 48 Devonshire Road, Montesano, WA 98563)from the
person to whom this Hydraulic Project Approval (HPA) is issued (permittee) or the agent/contractor
no less than three working days prior to start of work, and again within seven days of completion of
work to arrange for a compliance inspection. The notification shall include the permittee's name,
project location, starting date for work or completion date of work, and the control number for this

5. NOTIFICATION REQUIREMENT: If at any time, as a result of project activities including but not
limited to pile driving, fish are observed in distress or a fish kill occurs, or water quality problems
develop, immediate notification shall be made to the Washington Department of Ecology at 1-800-
258-5990 and the Area Habitat Biologist listed below.
UNLESS OTHERWISE INDICATED, THE FOLLOWING APPLY TO ALL ACTIVITIES:
6. Beach area depressions created during project activities shall be reshaped to pre-project beach
level upon project completion.
7. Project activities in the intertidal shall not occur when tidal waters inundate the project area,
including the work corridor.
8. Bed material shall not be utilized for project construction or fills.
MARINE HABITAT FEATURES:
9. Eelgrass and kelp shall not be adversely impacted due to any project activities (e.g., barge shall
not ground, anchors or spuds shall not be deployed, equipment shall not operate, and other project
activities shall not occur in eelgrass and kelp).
10. Removal or destruction of overhanging bankline vegetation shall be limited to that necessary for
the construction of the project.
11. Intertidal wetland vascular plants, such as pickleweed or saltgrass, shall not be adversely
impacted due to project activities (e.g., barge shall not ground, anchors or spuds shall not be
deployed, equipment shall not operate, and other activities shall not occur in intertidal wetland
vascular plants).
12. All natural habitat features on the beach larger than 12 inches in diameter, including trees,
stumps, logs, and large rocks, shall be retained on the beach following construction. These habitat
features may be moved during construction if necessary. Logs and stumps shall be secured during
temporary placement to remain on the beach.
WATER QUALITY:
13. Fresh concrete or concrete by-products shall be prevented from entering waters of the state. All
forms for any concrete shall be completely sealed to prevent leaching of wet concrete. Impervious
materials shall be placed over any exposed concrete not lined with forms that will come in contact
with state water. Form and impervious materials shall remain in place until concrete is cured.

14. No petroleum products or other deleterious materials shall enter state waters.
15. Trash, waste, chemically treated wood treated, or other deleterious materials resulting from
construction shall not be burned below the ordinary high water line. Limited burning of untreated
wood or similar material may be allowed at or above the mean higher high water line.
16. Erosion control methods shall be used to prevent silt-laden water from entering waters of the
state. These may include, but are not limited to, straw bales, filter fabric, temporary sediment
ponds, check dams of pea gravel-filled burlap bags or other material, and/or immediate mulching of
exposed areas.
ALSO APPLY TO PIERS, RAMPS AND FLOATS:
17. The existing structures to be replaced shall be removed and disposed of at an approved site,
unless relocation within waters of the state is authorized under a separate HPA.
18. New ramps shall have grating covering 100 percent of the surface area of the structure.
19. Floatation for floats shall be fully enclosed and contained or constructed to prevent the breakup
or loss of the floatation material into the water and shall not readily be subject to damage by
ultraviolet radiation and abrasion caused by rubbing against piling and/or waterborne debris.
20. Floats shall be deployed in such a manner the bed is not damaged.
ALSO APPLY WHEN PILE DRIVING IS USED:
21. A qualified biologist shall be on-site during all pile driving activities. The biologist shall maintain
a log/field book including the biologist name; contact information; observation date(s) and time(s);
weather and water conditions (i.e. clarity); description including location of pile being driven; and a
description of fish and wildlife observed in the marina basin. The description should include
identification of the fish and wildlife observed by the taxonomic name (family, genus or species)
and/or common name, as well as the approximate number and behavior observed in the marina
basin. Other information the biologist judges to be relevant should also be recorded in the log/field
book.
A copy of the log/field book should be sent to the WDFW Area Habitat Biologist listed below at 502
High Street, Suite 112, Port Orchard, WA 98366 within two weeks of the completion of the pile
driving work .
22. Prior to the start of pile driving, the biologist shall conduct a visual survey of the entire marina
Vit._, basin to ensure juvenile salmonids are not present. The survey of the entire basin shall be
conducted each day immediately prior to the start of any pile driving. The survey of the entire basin
shall also be conducted if pile driving is stopped and resumed in the same day. The survey shall
be conducted immediately prior to the resumption of pile driving.

In addition to conducting visual surveys of the entire marina basin, the biologist shall observe the
immediate work area while each pile is driven.
23. If juvenile salmonids are observed in the marina basin, no pile driving shall occur until the
juvenile salmonids are observed leaving the marina basin.
24. Piling removed from the area to be dredged shall be fully extracted. Piling removed from the
area that will not be dredged shall be fully extracted unless piling are damaged during removal
such that full extraction cannot be achieved.
25. Piling outside the dredge footprint that cannot be fully extracted shall be cut off a minimum of
two feet below the mudline and the resulting hole shall be filled with clean sand or gravel.
26. All piling and pieces thereof removed shall be disposed of upland such that they do not enter
waters of the state.
27. As per the approved plan, replacement pilings shall be steel or concrete.
IMPACT DRIVING OF STEEL PILES INCLUDING PROOFING:
28. Impact driving of steel piling including proofing is not authorized under this HPA. Installation of
piling shall be conducted using a vibratory hammer only.
ALSO APPLY IF TREATED WOOD IS USED:
29. All lumber, and other materials treated with preservatives shall be sufficiently cured to minimize
leaching into the water or bed.
30. All treated wood lumber to be used for the project shall meet or exceed the standards
established in, 'Best Management Practices For the Use of Treated Wood in Aquatic Environments'
developed by the Western Wood Preservers Institute, revised July 1996. All ACZA e.g. Chemonite
treated wood piling and lumber shall be treated by the manufacturer per the Post Treatment
Procedures outlined in 'BMP Amendment#1 -Amendment to the Best Management Practices for
the Use of Treated Wood in Aquatic Environments: USA Version - Revised July 1996', by the
Western Wood Preservers Institute dated April 17, 2002 or current revision.
31. Sawdust, drillings, and trimmings from treated wood shall be contained with tarps or other
impervious materials and prevented from contact with the beach, bed or waters of the state.
32. All float piling, built of treated wood, shall have rubbing strips attached around the
circumference of the piling to prevent contact with the float and or float collar. Rubbing strip
material shall be composed of ultra high molecular weight (UHMW)type plastic, or high density
polyethylene (HDPE)type plastic.

The Point Hudson Marina is located in the City of Port Townsend at 103 Hudson Street, Port Townsend,WA 98368.
APPLY TO ALL HYDRAULIC PROJECT APPROVALS
This Hydraulic Project Approval pertains only to those requirements of the Washington State Hydraulic Code,
specifically Chapter 77.55 RCW(formerly RCW 77.20). Additional authorization from other public agencies may be
necessary for this project. The person(s)to whom this Hydraulic Project Approval is issued is responsible for applying
for and obtaining any additional authorization from other public agencies(local,state and/or federal)that may be
necessary for this project.
This Hydraulic Project Approval shall be available on the job site at all times and all its provisions followed by the
person(s)to whom this Hydraulic Project Approval is issued and operator(s)performing the work.
This Hydraulic Project Approval does not authorize trespass.
The person(s)to whom this Hydraulic Project Approval is issued and operator(s)performing the work may be held
liable for any loss or damage to fish life or fish habitat that results from failure to comply with the provisions of this
Hydraulic Project Approval.
Failure to comply with the provisions of this Hydraulic Project Approval could result in a civil penalty of up to one
hundred dollars per day and/or a gross misdemeanor charge, possibly punishable by fine and/or imprisonment.
All Hydraulic Project Approvals issued pursuant to RCW 77.55.021 (EXCEPT agricultural irrigation,stock watering or
bank stabilization projects)or 77.55.141 are subject to additional restrictions, conditions or revocation if the Department
of Fish and Wildlife determines that new biological or physical information indicates the need for such action. The
person(s)to whom this Hydraulic Project Approval is issued has the right pursuant to Chapter 34.04 RCW to appeal
such decisions. All agricultural irrigation,stock watering or bank stabilization Hydraulic Project Approvals issued
pursuant to RCW 77.55.021 may be modified by the Department of Fish and Wildlife due to changed conditions after
consultation with the person(s)to whom this Hydraulic Project Approval is issued: PROVIDED HOWEVER,that such
modifications shall be subject to appeal to the Hydraulic Appeals Board established in RCW 77.55.301.

APPEALS INFORMATION
If you wish to appeal the issuance or denial of, or conditions provided in a Hydraulic Project Approval,there are
informal and formal appeal processes available.
A. INFORMAL APPEALS (WAC 220-110-340)OF DEPARTMENT ACTIONS TAKEN PURSUANT TO RCW 77.55.021,
77.55.141, 77.55.181, and 77.55.291: A person who is aggrieved or adversely affected by the following Department
actions may request an informal review of:
(A)The denial or issuance of a Hydraulic Project Approval,or the conditions or provisions made part of a Hydraulic
Project Approval;or
(B)An order imposing civil penalties. A request for an INFORMAL REVIEW shall be in WRITING to the Department
of Fish and Wildlife HPA Appeals Coordinator, 600 Capitol Way North, Olympia,Washington 98501-1091 and shall be
RECEIVED by the Department within 30 days of the denial or issuance of a Hydraulic Project Approval or receipt of an
order imposing civil penalties. If agreed to by the aggrieved party,and the aggrieved party is the Hydraulic Project
Approval applicant, resolution of the concerns will be facilitated through discussions with the Area Habitat Biologist and
his/her supervisor. If resolution is not reached,or the aggrieved party is not the Hydraulic Project Approval applicant,
the Habitat Technical Services Division Manager or his/her designee shall conduct a review and recommend a decision
to the Director or his/her designee. If you are not satisfied with the results of this informal appeal, a formal appeal may
be filed.
B. FORMAL APPEALS(WAC 220-110-350)OF DEPARTMENT ACTIONS TAKEN PURSUANT TO RCW 77.55.021
(EXCEPT agricultural irrigation, stock watering or bank stabilization projects)or 77.55.291:
A person who is aggrieved or adversely affected by the following Department actions may request a formal review of:
(A)The denial or issuance of a Hydraulic Project Approval,or the conditions or provisions made part of a Hydraulic
Project Approval;
(B)An order imposing civil penalties;or
(C)Any other'agency action'for which an adjudicative proceeding is required under the Administrative Procedure
Act, Chapter 34.05 RCW.
A request for a FORMAL APPEAL shall be in WRITING to the Department of Fish and Wildlife HPA Appeals
Coordinator,shall be plainly labeled as'REQUEST FOR FORMAL APPEAL'and shall be RECEIVED DURING
OFFICE HOURS by the Department at 600 Capitol Way North, Olympia,Washington 98501-1091,within 30-days of
the Department action that is being challenged. The time period for requesting a formal appeal is suspended during
consideration of a timely informal appeal. If there has been an informal appeal,the deadline for requesting a formal
appeal shall be within 30-days of the date of the Department's written decision in response to the informal appeal.
C. FORMAL APPEALS OF DEPARTMENT ACTIONS TAKEN PURSUANT TO RCW 77.55.021 (agricultural irrigation,
stock watering or bank stabilization only), 77.55.141, 77.55.181,or 77.55.241: A person who is aggrieved or adversely
affected by the denial or issuance of a Hydraulic Project Approval, or the conditions or provisions made part of a
Hydraulic Project Approval may request a formal appeal. The request for FORMAL APPEAL shall be in WRITING to
the Hydraulic Appeals Board per WAC 259-04 at Environmental Hearings Office,4224 Sixth Avenue SE, Building Two-
Rowe Six, Lacey,Washington 98504;telephone 360/459-6327.
D. FORMAL APPEALS OF DEPARTMENT ACTIONS TAKEN PURSUANT TO CHAPTER 43.21 L RCW: A person
who is aggrieved or adversely affected by the denial or issuance of a Hydraulic Project Approval,or the conditions or
provisions made part of a Hydraulic Project Approval may request a formal appeal. The FORMAL APPEAL shall be in
accordance with the provisions of Chapter 43.21 L RCW and Chapter 199-08 WAC. The request for FORMAL APPEAL
shall be in WRITING to the Environmental and Land Use Hearings Board at Environmental Hearings Office,
Environmental and Land Use Hearings Board,4224 Sixth Avenue SE, Building Two-Rowe Six, P.O. Box 40903,
Lacey,Washington 98504;telephone 360/459-6327.
E. FAILURE TO APPEAL WITHIN THE REQUIRED TIME PERIODS results in forfeiture of all appeal rights. If there is
no timely request for an appeal,the department action shall be final and unappealable.

PROPOSAL DESCR IPTION
PROPOSED DEVELOPMENT: The proposed development is normal maintenance and repair of the
existing travel lift pier and support piles in the Point Hudson marina in Port Townsend, WA. Other Point
Hudson marina repairs and reconfigurations activities, including the replacement of some travel lift piles,
are described in the Shoreline Substantial Development permit (LUP # 05-114). This proposed
development includes replacement of the travel lift pier and remaining creosote-treated wood piles as a
normal repair activity for wood structures in the marine environment, damaged by the elements (in this
case, wood rot and disintegration), per WAC 173-27-040 2(b). Without these repairs,the travel lift pier
can no longer perform its established function or use in providing boat access between the existing marina
and the existing upland boatyard and its marine services. The marina and its facilities, including the
travel lift pier, are legally owned and operated by the Port of Port Townsend. The Port proposes normal
repairs to restore the travel lift pier to its original condition, including size, shape, configuration, location
and external appearance, with two exceptions made to accommodate environmental considerations and
avoid adverse effects to shoreline resources. The two exceptions are 1) a reduction of about 500 sq.ft. in
the original footprint, to reduce shading of the aquatic environment, and 2) the replacement of 25
creosote-treated wood piles (12-to 16-inch diameter) with 22 steel piles (10.75-inch diameter), to reduce
chemical leaching into the water column and to decrease the number and size of piles that occupy aquatic
habitat.. The proposed design, materials, and construction methods are standard for this type of structure
in the marine environment.
The discovery of extensive rot was made recently (mid-January) and efforts were started immediately to
obtain permission to initiate repairs. The proposed repairs will not cause substantial adverse effects to
shoreline resources or the environment because the damaged materials will be removed from the marine
environment and properly disposed of,the replacement materials are not environmentally hazardous, and
the proposed construction methods have already been approved and conditioned by state and federal
resource agencies for Point Hudson marina repairs. The proposed travel lift repairs will be made
concurrently with ongoing Point Hudson marina repairs.

USE: The travel lift pier is an existing, marine, water-dependent structure used to transfer boats between
the marina and the adjacent boatyard and marine services business.

Findings& Conclusions
1. The proposal made by the applicant to undertake the repairs described above within the
shoreline of the City of Port Townsend and/or its associated wetlands is exempt from the
requirement of a substantial development permit. Specifically, the proposal constitutes:
X Normal Maintenance and Repair_Development not exceeding $2,500
_Single-family home for owner's use _Other:
Replacement of the travel lift pier and remaining creosote-treated wood piles as a normal
repair activity for wood structures in the marine environment, damaged by the elements
(in this case, wood rot and disintegration).
2. Repair/replacement of the travel lift pier will not materially interfere with the public use
of public lands and waters or the private use of adjacent private lands nor will it result in
any material expansion or change in use beyond that previously existing.
3. The use/activity is consistent with the policies of the Shorelines Management Act(SMA)
and the City's Shorelines Master Program (SMP). The travel lift pier is an existing,
marine, water-dependent structure used to transfer boats between the marina and the
adjacent boatyard and marine services business.
4. The Port of Port Townsend has issued an Addendum to the Determination of
NonSignificance Point Hudson Marina Docks and Marine Facilities Upgrade Project
(finaled on January 23, 2006)to reflect the travel lift repair/replacement. As proposed,
repairs will not cause substantial adverse effects to shoreline resources or the
environment because the damaged materials will be removed from the marine
environment and properly disposed of,the replacement materials are not environmentally
hazardous, and the proposed structure and construction methods have already been
approved and conditioned by state and federal resource agencies. In addition, all
applicable mitigation measures from the previously issued DNS for Point Hudson marina
repairs will be implemented.
Conditions
1. All development shall be in substantial conformance with the development plans
submitted in the application for Shoreline Exemption. There shall be no further
expansions to or addition of any structures seaward of the existing permitted development
without prior review for conformance with the Shoreline Master Program and any other
applicable laws and ordinances.
2. Construction shall be completed in conformance with an approved Hydraulic Permit

Approval from WDFW including adherence to the state-designated in-water work period
to avoid disturbing ESA listed species.
3. The proposal shall comply with all conditions of approval for Port of Port Townsend
Shoreline Substantial Development Permit LUP 05-114. These conditions include
adherence to mitigation measures set forth in the previously issued DNS for Point
Hudson marina repairs). Best management practices will be used for pier removal and
installation to minimize water quality effects.
4. The applicant shall apply for and obtain a building permit from the City of Port
Townsend.
5. Prior to undertaking any activity in the right-of-way, the applicant shall schedule a pre-
construction and traffic management meeting with the City.
6. This exemption does not excuse the proponent from complying with other local, state and
federal ordinances, regulations, or statutes applicable to the proposed development
including but not limited to the city's critical areas ordinance.
7. Pursuant to Section 3.401 of the SMP,this exemption shall automatically expire one year
from the date of issuance.
In consideration of the above, the proposal is found exempt from the requirement of a shoreline
substantial development permit.
