Port Townsend Municipal Code, Section 16.04.140, Vested Rights - Substantially Complete Building Permit Application: applications for all land use and development permits required under ordinances of the city shall be considered under the zoning and other land use control ordinances in effect on the date a fully complete building permit application, meeting the requirements dentified in this section, is filed with the Development Services Department. The fees are calculated using the estimated fair market value of the project (material + professional labor costs). The value .includes the total value of all construction work, including finish work. The Plan Review Fee, which is 65% of the Building Permit Fee, is paid at the time of application submittal. The values may be adjusted to coincide with the quality and individual characteristics of your project. The Building Department will establish an estimate using "good" values per square foot for similar buildings in the region. These estimates are updated on a regular basis. This property, as part of a Short Plat, is subject to the Tree Conservation Ordinance. The Port Townsend Municipal Code Table 19.06.120(D)l states that in the R-IIl residential zone 30 tree units are required per 40,000 square feet. Lot 9 is 5,000 square feet in size, so 4 tree units are required. If there are existing trees, please use the following trunk diameters at 4-1/2 feet above the ground to determine the tree units: 1" - 6" diameter at 4-1/2 ft. above the ground equals 1 tree credit; 7" - 19" equals 2 tree credits; 20" and greater equals 3 tree credits. Trees must be protected during construction. If you need to plant trees, please use the following: small to medium tree species which at maturity grow up to 40 feet tall equal .50 tree units; large species which at maturity grow over 40 feet tall equal 1 tree unit; each deciduous tree must be minimum 3/4" caliper within 6" of the ground at time of planting. Each evergreen tree must be minimum Y tall at time of planting. A minimum of 1 coniferous species is required, preferably of native species. Trees must be planted prior to the final building inspection. Please submit a site plan of Lot 9 showing the location, size and type of existing trees and/or trees that will be planted. NW Seabeck, WA 98380 SUBJECT: Duplex revision — Permit BLD07-001 Dear Mr. Tracy: r As a follow-up to our meeting on Wednesday the 21St I am providing this summary, which will serve to provide a level of assurance for the preparation of your construction plans. The property at 408 Eddy Ct. is zoned as R -III. This zone allows up to 45% lot coverage and the site plan submitted with the permit application BLD07-001 shows compliance with this. The lot has 3 street frontages, which creates somewhat atypical setbacks. However, the plan submitted does comply showing setbacks of 10 feet from the adjoining streets with a 20 -foot setback for the garage. The rear (or side yard in this case) is 5 feet. A new building plan contained within the same footprint area would be. deemed to satisfy the minimum setbacks. It is my understanding that you will submit a revised building plan for a duplex style building with two separate garages, this would be within the allowed density for the site. Please note that the garage fronts must be setback a minimum of 20 feet from the adjoining street under the setback provisions. This will also allow you to have a parking space in front of each garage and thereby satisfy the requirement for two parking spaces for each dwelling unit. I will keep the !application and wait for you to submit. the revised building plans. The fees paid will be credited to the revised application. The current permit application is valid for 180 days from application, which would take it to June 8"'. If you need more time to complete the new submittal please provide. a written request by June and I can provide a 90 -day extension of time. NW Seabeck, WA 98380 SUBJECT: Building Permit Application # BLD07-001 Dear Mr. Tracy: I have received and reviewed your submittal for construction of a duplex 408 Eddy Ct.. There are some modifications and revisions that will be required in order to approve the permit for construction. There is apparently a misunderstanding related to the parking requirements for this building as reflected by the calculations shown on the cover sheet. A duplex requires a total of four (4) onsite parking spaces under the provisions of 17.72.080 of the municipal code. The plan as presented shows only two (2) onsite spaces. A revised design layout will need to be provided that provides the required minimum onsite parking. The revised site plan should also reference how the yards have been designated for setback purposes; which yard is to be considered front and which is to be considered as rear. The original plan submittal was for a duplex with an ADU. The current submittal has been revised to join the former ADU with one of the lower floor units. However there are still a number of references on the plan set to ADU, which should be removed. Also please provide an explanation of why the building will need three (3) separate meters, panels, boilers and hot water tanks. While these items are not prohibited, their presence on the plan set does suggest a tacit approval of an ADU, which is clearly prohibited. Once the revised plan sets are provided I will complete the review and permitting process. Thank you. I noted and told Tom that an MIP was required for the project and that needs to be submitted. Tom assured me he would take care of it soon. Could plan review of this take place soon, so that at least that part would be done, and hopefully he will turn in the MIP right away.
