Opening Business Chairman Floyd called the meeting to order at 7:45 P.M. Members present were John Floyd., Bili Henderson, dim Campbell., Julie McCulloch, harry Dennison, Wanda Blacks and Jean Camfield. Julie McCulloch moved that the minutes be approved as written. Ilan Black seconded the motion and 3*.t passed unananously. Chairman Floyd reminded the co�rm�issian that there would be a workshop on January 14, x982. Commissioner McCulloch had went to a Land Use Seminar and Commissioner Dennison • had been present at a seminar on Rural Communityaanning. Chairman Floyd stated that two public noti,ces should be pasted for the January 28, ].982 meeting. One for the Ware Short Subdivision and one for the Kah Tai Care Center Rezone. II. Sudlow Trust Application John J. Sudlow, Jr. , for classificati*on as open space or timberland Trust for Current Use Assessment The request- is for 8.33 acres don ated as timberland dor -Current Use Assessment. The Sudlowts plan to use it as timberland. Ms. Swallow explained that the proposed plan does comply with the law i*n that it inio d be open space, undeveloped land. Tree planting was scheduled to start December 18,, 19$1 with the eventual harvest-used as pulp. Chairman Floyd stated that this proposal gave a tax advantage to the applicant if kept in Forest Management far at ].east 10 years. If property removed before that time., then owner would be required to pay back taxes plus penalties. The present condition of the land is clear cut. the open space is the benefit to the public. The commission discussed whether the tax loss was worth the open space benefit. Larry Dennison moved that this Current Use Tax Assessment far timberland • be recommended f arapproval and the change in the comprehensive plan be recommended as 'it meets the criteria set forth in 1,234 5 of R.C.W. 84934*0206 Jim Campbell seconded the motion and the vote was unanimous. -1- • III. Brawn, Sr. Rezone from RI & R3 to CII 133.Q Clay St. fort Townsend, oda. 98368 The applicant requests,-the rezone to allow himto operate his business as an electrical contractor and service agency at his residence. Mr. Brown states on his application that if the, rezone is allowed there would be no signs on any bui*lding depicting a retail. sales business and that the purpose of the garage on his property is for receiving and dispensing of materials to conduct lois business from his suPPliers to hi"S customers. During the hearing Mr. Brown stated that it was f inancial3.y impossible to have his business anywhere alae. He added i*t was mostly a warehouse operati'ono There was a letter from A re d Ramey in opposition t o the rezone. It would be sent on to the Council. There was also a letter in onposition to the rezone from Paula Amell because we should not have hit and miss zoning. This would set a president. Randal Kelly stated that commerciLal zoning in this area was inconsistent with the rest. If it was zoned CII we could end up urith a McDonald I s or an auto 'I repair shop across the street. When Mr. Brown asked C1.ty Engineer Rogar wench whether he could operate $ business with a conditional use pe" t. Mr. French said., a Conditional Use . did not apply. Chairman Floyd stated the Commission was conce ed with the CII zoning, not whether Mr: Brawn has his business there or not, After reviewmingdo the facts, Jean Camfi'eld moved that Application No. 781-03 be recommended fax denial- as int doepor% nat comply with the Port Townsend quEfto" (;Omprehensive Flan and is not in the public's interest as it would intrude into th6 residential area.
