The. applicant requests the vacation of the et -thr • feet of the sixty-six
Feet wide Grant Street right-of-way which borders the, applicant's property
from the First Street Tight-of-way south to the north, boundary of the adjacent
lot. The single-family residerice on the property intrudes into the Grant
Street right-of-way approximately- one and one half' feet., Applicant requests
the vacation to clear title for -the impending sale +of,-+ the.property. Michael

Helen Duston stated she did not mind the vacation, but.wanted First;Street .
unproved by the city as it was the only -access to part of her property.

Don Ware w' friend of Mrs. Dudle toh, stated that Mrs. Dudleston did not have
access to part of her property except by First Street-and she wanted it improved,,

Dave Colbert.,.said that he was proposing to boxy this property. He wanted to know

Chairman Garman' told him that s long as he 'didn't in reale the degree of non-
conformity, he could bui.ldran addition. Any addition-. that .would increase the
degree of non-conformity.would requ rea variance -permit.

Bob Brim, representing the committee, said that he reviewed the property and.
went through review criteria for a street vacation and found no problem with

Bob Grp moved to recommend to the City Council the approval of Street Vacation

the motion and the vote was unanimous.

Background
Applicant requests vacation of the east three feet of
the sixty-six feet wide Grant Street right-of--way which borders
the applicant's property from the First Street right-of-way,
south to the north boundary of the adjacent lot (Lot 1, Island
Vista .
The single family residence on the property intrudes into
the Grant Street night-of--way approximately 1 .5 feet. Applicant
seeks the vacation to clear title for impending sale of the
property. The concrete slab drive to the garage extends into the
Grant Street right-of-way approximately 13.5 feet.
The front yard setback after the vacation would range from
approximately 1.5 to 3.75 feet if the vacation is granted. Built
prior to enactment of the Port Townsend zoning code (1971) , the
residence is a legal, nonconforming structure in the R-IA zoning
district.
Recommendat
The proposed street vacation is in compliance with the goals
and policies of the comprehensive plan and the review criteria
set forth for street vacations. This small., partial vacation
does not conflict with any municipal services, current or
antic.ipated.
It is recommended that the request be GRANTED.
Draft findings and conclusions are attached for your
consideration.

After respectful consideration of the above referenced appli-
cation including on-site inspection of the property, and after
timely notification and Dearing, the Port Townsend Planning
Commission hereby submits to the City Council the following
findings and conclusions:
1. Applicant requests vacation of the east three feet of
the Grant Street right-of-way which borders the appUcantvis
property from the First Street right-of-way, south to the north
boundary of the adjacent lot Lot 1, Island Vista) .
2. The single family residence on the property intrudes into
the Grant Street right-of-way approximately 1 . 5 feet. Applicant
seeks the vacation to clean title for impending sale of the
property.

emergency services will not be impaired by the proposed vacation.

7 . Because the proposed street vacation conforms with the goals
and policies contained in the comprehensive plan and satisfies
the review criteria for street vacations set forte in Section
12. 20. 060 PTMC, the Port Townsend Planning Commission recommends
that the above referenced application be GRANTED.
