Members present were Nancy Slater, Pon McLarney, P b Grimm, Pon Kosec, Jim Taverna is and Alan Carman. Also present were Joan Deering, Charles Wallin, Madge Wallin, Helen A. Allan, City Attorney Keith Harper, and City Planner Michael Hldt. II .. The minutes were approved from the meeting of May 7, 1987 . III . Application No. 487-03, Conditional Use, Joan and Davis Deering, Bed and Breakfast Inn. Nancy Slater stated that due to a conflict' of interest she would not participate in the consideration or r-ecommendat'ion on this application and left the room. City Planner Michael Hildt presented his br�.iefing and recommendation. He stressed the parking requirements, current parking conditions in the neighborhood and the potential for joint use parking with the Fret Presbyterian Church. He also discussed the existing rennt l unit over the garage and alternative ways the Commission could assure it is brought into compliance with the zoning code. He recommended the application be granted on a trial basis for one year with certain conditions. A copy of his written recommendations are on file. Mr. Grimm asked if the application could be amended to include the unit over the garage Mr. Harper stated that although there is- no expressed provision for- amendinit an applic -t'iori-, pas, policy has been t permit it whenever- it is Treasonable o do so and would not result in a change so substantially different from the . origRr inal application, that it would be environmentally significant. He indicated A at -succi an amendment would not be so substantial in the case at hand and suggested that the City Council Legislative- and-Environmental Committee make such a finding if that is the Commission's: recommendation. Harper then reviewed the discretion and alternatives available to the city to enforce the zoning code and bring non-conforming conditions into compliance. He advised that the City act expeditiously to cause violations to be corrected whenever they aro discovered. Dr. Ta ern kis asked if future use of the unit over the garage as an apartment would be a violation if it is included as part of a conditional use permit for a bed and breakfast inn at this time. Mr. Harper answered that it would not be a violation inasmuch as an apartment is a permitted use in the R district. provided the parking and other zoning requirements were met. ._ . Dr. Taverna is asked if the Commission could permit a total of five guest units Mr. harper~ replied that such an expansion of the application would properly require that the application be amended and the environmental checklist be' reviewed by the Council. He ... stated that this would be particularly so in view of the parking concerns. L Mr. Harper reviewed the joint use parking provisions of the =� zoning code and expressed the opinion that a bed and breakfast inn 'is primarily a `.nighttime" use and a church is primarily a "daytimes' use as contemplated by 17. 28 . 080 PTMC. Mr. Carman called on Ms. Deering to present her application. Ms. Deering reviewed the recent history of the house and the improvement made sJ_nice they ,purchased it , in March, 1984. She --slated that 'the house was occupied by-two fa llie and a third family lived over the garage at the time they purchased the property. She explained that the family over . the garage continued to rent the quarters until the fall of 1984 at which time they remodeled it, first for the use of visiting relatives and later~ offered it -for transient lodging. In the summer of 1985 they started renting it monthly, weekly or daily or whatever they could get. Before starting this, they went to Mr. Str icklin to see if there was any permitting that was needed for doing this. " Ms. Deering also stated that as she had assumed that a permit for a bed and breakfast inn would be continuous, she requested four guest rooms be included for the possibility that they may wish to offer an additional room in the distant- future. Currently they aro prepared to offer three rooms in the house in addition to the unit over the garage. ` Mr. Carman 'then opened the floor- for public testimony. Charles and Madge Wallin expressed concerns about parking, planned expansion of the First Presbyterian church, the proximity of the Deering's garage to thein property, the fact that their house had not been cited on the environm ntal check list as ars historic structure, and that they have been unable to build a fence higher than permitted by-the zoning code adjacent to the Deering driveway without applying for a variance. Mr. Wallin also presented several phbtogl-a hs of parking congestion near the proposed bed and breakfast inn. Ms . Allan stated that she has lived across the street from the eering's garage for over forty years and recalls when Mrs. Cotton, a former owner, had the apartment built in the 1940's for her daughter. She explained that though her house faces the property the rental unit over the garage has =- never been a problem and sees no reason why it should not b continued. She stated that she has noticed no difference . . from a neighborhood standpoint since the Deerings have rented out the apartment to tourists_ Dr. Tavernakis asked Ms. Wallin about the photographs. Me. Wallin replied that she has never been concerned about the apartment over the garage but questions adding four more units within the house, Ms. Deering explained that there were three families living on the property when they purchased it and expected the parking problems. to be considerably less. a bed and breakfast inn. - .. r Mr. Carman closed the hearing and called on Dr. Tai ernakis, the chair of the review committee, to snake a recommendation. Dr. Taverna is recommended granting the request subject to certain conditions, including- the unit over the garage as part of the bed and breakfast inn.. Grimm seconded the motion. The motion passed by a roll call vote of 5 -- 9 with Ms. Slater abstaining. Ms . Slater returned to the room. H . Upcoming Workshop on Downtown Parking. Mr. Hildt passed out copies of his draft recommendations for downtown parking plan and discussed arrangements for a public forum before the Commission on Thursday, June 11 . III . After respectful consideration of the above referenced appli t cation including on-site inspection of the property, and after timely notification and hearing, the Port Townsend Planning �- Commission hereby submits to the City Council the following findings and conclusions: i ' Findings 1. Applicant proposes to establish a four-room bed and breakfast inn from May through September in their existiing residence at 1208 Franklin Street. A .though the Port Towle send zoning code does not make provisions for bed and breakfast inns, conditional use permit has been required in the past in lieu of �- specific requirements. } 2. The subject property is zoned -111 and is legal, nonconforming as to lot coverage and setbacks. 3. The subject property is on the northwest corner of Franklin and -Filmo -e Streets. Single-family, development- surrounds the property and the First United Presbyterian church and parking lot are diagonally to the east across the Franklin/Filmore intersection. _ The four off-street parking spaces required by the -zoning code will be provided. Conclusions 1 . The proposed bed and breakfast use will continue the external -. appearance of the existing structure and will not add s3.gnificantly to existing parking or traffic conditions. The City Counc11 found at its meeting of May 5, 1987 , that the proposal would not have any significant adverse environmental impacts. Planning Commission, 487-03 Page 1 of 2 F .y 2. The proposed bed and breakfast use of the subject property and will not endanger the public health or. Bafety, nor will nuisance be created. 3. The proposed use will be required to meet all of the condi- tions and specifications set forth in the --III zone in which the property is Iodated except for those legal, nonconforming condi- tions which were in existence prior to the enactment of the Port Townsend zoning code in 1971 . . The proposed use will not be- injuriouB or detrimental to adjoining or abutting property. . The location and character of the use will be in harmony with the area -in-which--it- i - located -and .1 --genera I-conformity-with - t . the Comprehensive Plan. . In consideration of the aforementioned findings and conclusions, the Planning Commission recommends that the above referenced application be GRANTED AS CONDITIONED: The Conditional Use Permit is granted for a renewable period of three gears and applicable regulations of the Port Townsend Fire Department and the Jefferson County Health Department must be met.
