Ms. Sherwood moved to recommend approval of street Vacation
application 8909-05 to City Cou.ncil Mr. Grimm seconded and the
motion passed unanimously.
B. Conditional Use 910-01 , Clayton Cook
1. Staff Presentation and Review
Mr, O'Neill distributed a copy of a letter received from the Port
Townsend Historic Preservation Commission concerning the review
of the proposed expansion. Dr, Taernakis read the letter into
the record.
Mr. O'Neill reviewed the proposed expansion. ,The applicant
proposes a 1 , 200 square foot expansion to an existing building
located at 627-31 mater Street in the -111 zoning district. The
applicants propose to use the addition for off ic-e space medical
offices and a one-unit motel *
The Commission asked Mr, O'Neill to clarify issues relating to
the proposed expansion and zoning requirements and historic
building regulations.
2, Public Testimony
David McCullo h,, tenant of the building and representative for
the applicant, stated that the property is unique in that the
access is from the water side of building* He stated that he
would rather not have parking in the rear but would like t
preserve the area to be compatible with its surroundings.
Public Testimony was closed.
Committee Report (Carman/Sherwood)
. Carman asked the applicant how he plans to respond to the
recommendations from the Historic Preservation commission* The
ppl icrt said he will keep their interests in mind. Mr. Cannan
said he found no faults in the application.
M . Sherwood stated that the building is not the same as other
buildings in the historic district so making the addition look
historic would not be compatible. She agreed , that the
application was acceptable.
Mr. Carman moved to recommend approval City Council Conditional
Use 8910- 1, Clayton Cook. Ms. Sherwood seconded.
Discussion, Mr, Tavernaki s asked the applicant for some

clarification on the proposed parking plan.
The motion passed -1 in favor of approval with Ms, Erickson
dissenting.
C. Variance 8910-02, Allan and Rosalind Cunningham
1. staff Presentation and Review
Mr. O'Neill reviewed two draft Findings of Fact and Conclusions
for the variance request. Draft A recommends denial while Draft
recommends approval . The previous owner of the property hal
begun construction of a 200 square-foot carport/deck, The
addition was built to within 12 feet of the front property line
without a building permit.
Ir. O'Neill advised the Commission that City Attorney, Keith
Harper, recommended the Commission revise Conclusion 2 in Draft
if it is decided to adopt that draft.
Public 'testimony
Al Cunningham, applicant, stated his case for approval of the i
application.
Public Testimony was closed.
3 . Committee Report (Carman/Erickson)
Ms. Erickson stated that she was unable to identify a► hardship
that would allow the variance and stated tate approval of the
variance would set a bad precedent.
Mr. Carman stated that some of the adjacent streets will not be
developed because of adverse grades and that the applicant did
not cause the action that caused the non-compliance,
some discussion followed over whether the construction was 90
complete. Ni . Losec stated that setback variances have not been
judged on the amount of traffic on adjacent streets.
Ms, Erickson moved to approve Draft A of the Findings of Fact and
Conclusions recommending to City Council the denial of the
variance application. Mr. Carman seconded.
Discussion. fir. Carman stated that Conclusion 2 does not
adequately address the hardship of the applicant. He stated
that the previous owners caused the nonconformance. Nor. Carman
suggested that Conclusion 2 be revised to reflect that the
applicants did not cause the non-conformity. After some
discussion the Commission decided not to revise the drafted

Findings and Conclusions.
The motion for denial passed 5-1 as drafted by staff with Alan.
Carman dissenting.
4 . Findings and Conclusions
D. Final Plat, Bay vista Condominiums
Mr. O'Neill reviewed the documents received from the applicants
and pointed out some of his concerns.
Mr. Carman listed some additional requirements that must be added
to the plat. And asked for some clarifications on the survey.
Mr. Carman recommended the plat be continued for review at the
next Planning Commission hearing and that the -application be
properly noticed . Erickson seconded and the motion passed
unanimously.
