Street vac t ion, 8909- 3, Robert and Sally- McDole Ms. McDole left the room due to a conf l:ict iri -interest. 1 , staff presentation and Review M r Mr. O'Nei l presented a memorandum from Public is Works director Ted tr icklin which recommended denial of the application. Mr. O'Neill reviewed the application which requests the vacation o the McNeill Street right-of-way extending from' 33rd Street north to 35th Street. Mr. O'Neill reviewed two drafts of Findings of Fact and Conclusions. Draft A recommending denial while Draft recommended approval. . Public Testimony I Helen Ca valer , one of the applicants and a neighboring property owner, stated she supported the vacation of the right-of-way to preserve the flora. 3 . Discussion ensued regarding the width of the utility easement. Nix . Carman recommended that the applicants work with the Parks Department to set up a trail system, M . Sherwood moved to recommend to City Council that Draft A of I. the Findings of Fact and Conclusions be adopt6d, recommending denial of Street vacation Application 8909-03, Mr. Kosec seconded. The Commission discussed adding a conclusion stating that the Commission supports the intent of the applicant. The motion was amended to add a Conclusion ..stating that the Commission supports the intent of the application and encourages the applicants to work with the Parks and Public Works Departments to achieve the goals of the applicant. A vote was taken on the amended motion and carried unanimously. Conditional Use Application 8910-03 , Port of Port Townsend . McDole joined the Commission at this time. 1. Staff Presentation and Review Mr. O'Neill reviewed the application. The applicant proposes t establish a temporary office structure on a portion of vacated Benedict Street extending southeast of Washington Street. Ms. Sherwood asked Mr. 'Neill how long the trailer would be occupied. Ms. Erickson joined the Commission at this time, 8:05 p e m e . Public Testimony Andrea Fontenot, Pont Planner, spoke in favor of the application. William Toskey, Port Manager, also spoke in favor of the application. Committee Report Kosec/Erickson) 40 Some discussion followed with applicant concerning specifics of 0 Planning Commission---December 14, 1989 Page 3 of 5 the project. The commission noted that the project wound be exempt for shoreline review because of the size of the project. Some discussion followed. Ms. Erickson recommended that a qualifying statement be added to Condition 3 adding the phrase 'ion Application 8910-03 . 11 After further discussion, the Commission also requested that Conclusion #5 be added regarding the project's exemption from the provisions of the Shoreline Master Program. . Kosec mored to recommend approval of the application with the suggested amendments. Ids. Erickson seconded and the motion passed unanimously. O. Draft ordinance relating to review process for binding site plans. 1. Staff Presentation City Attorney Keith Harper, reviewed the draft ordinance. Mr. O'Neill distributed copies of definitions for binding site plans taken from FC:W 58.17. . Public Testimony Mr-. Staff Presentation and Review Mr, O'Neill distributed copies of the final plat and Draft Findings of Fact and Conclusions, He then reviewed the application. f Ms. McDole stated that the amended exterior building design was satisfactory, and that the applicant met the recommendations of the Commission. fir. Carman concurred. Mr, Carman moved to recommend to City council that the Bay Vista Condominiums Final Plat be approved. Ms, I cDole seconded and the motion passed -1 with Dr. Tarnakis dissenting.
