Reference: City Permit Number LUP14-073, Critical Area Permit Van Aller Survey, AFN J ,y6 g 5 3 Legal descriptions: 948-002-606— All of Lot 6 and Lot 5, less the Southeasterly 15 feet, Block 26, Dundee Place, an addition to Port Townsend, as per plat recorded in Volume 2 of Plats, page 52, records of Jefferson County; 948-002-607— Lots 7 and 8 in Block 26, Dundee Place, an addition to Port Townsend, as per plat recorded in Volume 2 of Plats, page 52, records of Jefferson County; Situate in the County of Jefferson, State of Washington. Grantors/Owners of the above-referenced real property,hereby notify potential purchasers and future owners,their agents or representatives, and any other concerned person or entity as follows: A. Van Aller Surveying conducted a field survey in September,2014. The survey found an area of prescriptive easement in favor of the City along the property frontage of Corona Avenue between sixteen(16)and twenty (20) feet in width where the pavement and City's sanitary sewer line are located, as shown on the above referenced survey to this Acknowledgement of Prescriptive Easement. B. In consideration of avoiding the cost and delay to Grantors' project of litigating a quiet title action to revise the property lines for these parcels, and of the mutual promises contained herein, Grantors acknowledge the existing encroachment of the Corona Avenue street improvements and sanitary sewer line as shown on the Van Page 1 of 2 Coopee-Zebas Actaiowledgement of Prescriptive Easement Aller survey, and agree that it constitutes a prescriptive easement for right of way and utilities in favor of the City. C. Grantors further agree that zoning code setbacks and setback area shall be calculated from the west side of the prescriptive easement, and that Owners shall setback and not build any structures within the setback or setback area. Owners further agree that that lot coverage shall be calculated based on the total area minus the prescriptive easement area. D.
