RESOLUTION NO. 15-018
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON RELATED TO THE DISPOSITION OF CITY PROPERTY;
AMENDING THE AFFORDABLE HOUSING INVENTORY LIST, AND DIRECTING
THE CITY MANAGER TO TAKE APPROPRIATE ACTIONS TO PRESERVE CITY-
OWNED PROPERTY FOR OPEN SPACE AND STORMWATER DETENTION AND
TREATMENT PURPOSES
WHEREAS, the City Council has previously adopted Resolutions 09-035, 10-024, and
11-018 establishing and amending the City's Affordable Housing Inventory List; and
WHEREAS, Resolution 10-024 added City-owned property at Beech and P Streets
within the City, (Jefferson County Assessor's Parcel Number 985204401) (the "Beech Street
Parcel") to the City's inventory of properties that could be used to support affordable housing as
provided for in Chapter 3.44 of the Port Townsend Municipal Code; and,
WHEREAS, Section 3 of Resolution 11-018 directed that staff not market the Beech
Street Property as affordable housing at the time; instead, it was to go through the City's
comprehensive planning process and, pending completion of that process, that Council would
determine the next steps for the property in connection with affordable housing; and,
WHEREAS, as provided for in Resolution 11-018,the City contacted local affordable
housing providers who assessed and determined that building affordable housing on the Beech
Street Property would not be feasible; and,
WHEREAS, during the 2012 Comprehensive Plan update cycle, a proposal was made to
rezone the Beech Street Property (LUP11-027,to rezone Beech Street and establish alternative
parcel-specific zoning). On December 19, 2011, Council voted to remove the rezone from the
comprehensive plan docket; and,
WHEREAS, during the 2014 Comprehensive Plan update cycle, a proposal was made to
rezone the Beech Street Property from POS/B to POS (Docket Item No. 6, LUP14-028, Beech
Street). This request was denied in Ordinance 3119. However, during the consideration of this
docket item, Council amended the Planning Commission's findings and conclusions. Council
discussion included statements that the Beech Street Property was not suitable for affordable
housing purposes; Council voted to remove language from the findings and conclusions related
to affordable housing. Also,the findings and conclusions were amended to express the Council's
determination that the Beech Street Property served an important purpose as open space, and that
it performed stormwater detention and treatment functions that benefitted the City's stormwater
system; and,
WHEREAS, PTMC 3.44.010A states in relevant part that, "[d]ecisions should be based
upon established criteria, and only after seeking public review and comment regarding all

proposed determinations that property which is subject to this chapter is surplus to city needs, or
whether property should be designated to meet affordable housing needs and surplused or
retained for that purpose;" and,
WHEREAS, based on the public testimony received during the comprehensive plan
process, Council's discussion and action during the comprehensive plan process, City staff
recommends that the Beech Street Property be removed from the Affordable Housing Inventory
List; and,
WHEREAS,the City Council considers the public testimony received during the
comprehensive plan process along with the public comment associated with this Resolution to
meet the "public review and comment"requirement of PTMC 3.44.010A;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend as follows:
Section 1. Resolution 10-024 is amended by removing the City-owned property at Beech
and P Streets within the City, (Jefferson County Assessor's Parcel Number 985204401)
from the City's inventory of properties that could be used to support affordable housing.
Section 2. The City Manager is authorized to negotiate and execute a conservation
easement for the Beech Street Property with the Jefferson Land Trust upon such terms as
would provide maximum protection for the property's open space and storm water
functions.
ADOPTED by the City Council of the City of Port Townse d at a regular meeting
thereof, held this 6th day of April, 2015.
