FOR AND IN CONSIDERATION OF One Dollar ($1.00)and othergood and valuable
consideration,Norman Odell,an unmarried man("Grantor"),hereby conveys and warrants,in
perpetuity,totheCity of PortTownsend,a Washington municipal corporation("Grantee"),its
successorsand assigns,a perpetualexclusiveeasement under,over,through and acrossthe
followingdescribedpropertysituateinJeffersonCounty,Washington,commonly known as
1258 Cedar Street,PortTownsend,legallydescribedas:
1.Legal Descriptionof Property Subjectto Easement ("Grantor'sProperty")
Lots 73,74,75 Supplementary Platof Cherry Park,Vol.2,page 19 of Plats,Records of
JeffersonCounty,Stateof Washington
2.Legal Descriptionof Easement ("Easement"or "Easement Area"):
A tenfootwide stripalong the westerlypropertyline,Lot 75 of Supplementary Plat
Cherry Park,Port Townsend,JeffersonCounty,more shown on the map attachedas
EXHIBIT A attachedheretoand incorporatedhereinby thisreference.

This Easement isforthepurpose of grantingthe City of PortTownsend easement rightsover,
through,and acrossthe easement areafornonmotorized uses and purposes only,includingany
improvements relatedthereto.Non-motorized use includesnon-motorized bicycles,scooters,
and wheelchairs(except,wheelchairswith batteriesmay be used by persons with disabilities

needing wheelchairs),provided,thisdoes not preventCitymotor vehiclesfrom performing
constructionor maintenance within the easement area.
This easement issubjecttothe followingterms and conditions,agreed to by the City ofPort
Townsend (asevidenced by the signatureoftheCity Manager below)and Grantors:
1.City shallconstructforthe owner a 6'high solidboard fence on the owner's property
adjacentto the eastsideof the 5'easement.
2.Grantor shallsetbackand not buildany structuresor locateany portionof a structure
withintheeasement areaor withina distanceof 5'from theeastsideof the easement.
For purposes of calculatinglotcoverage forGrantor'sproperty(Lots 73-74-75),lot
coverage shallbe calculatedbased on the totalarea of lots73-74-75 (withoutany
deduction forthe 5'easement area).
3.This agreement shallbe binding upon the Owner,Owner's heirs,personal
representatives,successorsand assigns,and the easement isacknowledged and declared
tobe a covenant running with the above-describedland.
4.Grantee agreesto indemnify,defend,and hold harmless Grantor from any and allclaims,
losses,costs,liabilities,injuriesand/ordamages (includingreasonableattorneys'fees)
sufferedby any person or propertywhich may be caused by or arisingout of,directlyor
indirectly,theGrantee's or itsagents',contractors',licensees'or invitees',exerciseof the
rightsgrantedherein,includingbut not limitedto,claims arisingfrom or resultingfrom
any construction,repairor maintenance withinthe easement area,provided thatGrantee
shallnot be responsibleforany claims arisingfrom thenegligence or intentionalconduct
of Grantor,Grantor'ssuccessorsand assigns,employees,agentsor independent
contractors.
